Privacy Policies

Unmatched requires parents or legal guardians to sign waivers/assumption of liability forms before children can participate in our programs. We treat family and individual data seriously. We do not share any member data unless formally requested for HIPAA purposes. Please reach out to us with any questions/concerns you may have. HEALTH: Youth Contact Info:

Preferred Names - To respect and affirm chosen names and nicknames

Given First and Last Name - To record legal names of youth

Pronouns - To respect and affirm desired usage

Birthdate and age - Confirm youths are between the ages of 5-18 to be eligible base members.

Allergies Medical - To record known allergens and prevent accidental exposure, and to prepare adequately for medical needs

Grade - School attendance data helps assess demand for programs and identify how youths are hearing of our programs

PERMITTED: Allowed Pick-up/Drop-off

We request up to five names to be listed to authorize youths to be picked-up by named adults if dropped-off. All youths must sign-in and sign-out during programs. Please read disclaimer text in the intake packet and reach out for more information.

Address data, notification opt-in options, and how best to contact allow our team to navigate youth and parents' wishes on confidentiality, legal authority, and identify gaps and needs in our membership.

DEMOGRAPHICS

Tracking members' interest in sports and fitness types as well as standard measures like gender, sexual orientation, age, racial and ethnic information, allows our team to identify who we are or are not reaching. In doing so, we can intentionally address equity-focused core community methods for inclusion; assemble committees; and attract teammembers who can especially advocate for minority needs.

Participation Waiver

Every youth needs a signed and completed waiver to participate in an Unmatched Athlete event.

I recognize that there are elements of risk associated with participating in any sport or fitness activity and that no amount of care, caution, instruction or expertise can eliminate these risks. 


I understand that by signing this participation waiver that I agree to have my child (or the youth under my responsibility), and myself, participate in any Unmatched Athlete’s Club Sports Program. I hereby release and forever discharge Unmatched Athlete’s partners (including board, employees, staff, coaches, officials, sponsors, and volunteers) from any present and/or future claims (excepting willful and gross negligence claims) including but not limited to claims for physical or mental injury, death, and/or economic injury to me or the youth, which pertain to and/or are ancillary to the activities associated with Unmatched Athlete. 

I understand and assume the risks with participating in any sport or fitness activity, and I have advised the youth of these risks. I further agree to indemnify and hold harmless Unmatched Athlete and its partners, brought by me, the youth, my heirs or the youth's relatives against Unmatched Athlete and its partners. This indemnification includes but is not limited to paying Unmatched Athlete and its partners for any judgment or settlement amount paid or incurred by Unmatched Athlete and its partners, and payment of Unmatched Athlete’s actual attorney's fees and costs in defending the claim.

Unmatched Athlete would like to share photos and videos of games and events on all of our media platforms, whether that be print or online. May we use your photo/video?

I understand that by signing the media waiver that I agree to have my child (or the youth under my responsibility) or myself, to be photographed while participating in any Unmatched Athlete event. This also extends to any photos, videos, or other likenesses to be used by Unmatched Athlete. I understand promotional activities may be made in any media even after we are no longer involved in the activities.

Conflicts of Interest

All officers of Unmatched Athlete must disclose any potential conflict of interest related to participation with the corporation. A conflict of interest may occur if a program or service is related to or has a business relationship with an employee or officer, or elected official. If it is determined there is a conflict of interest or potential conflict of interest, the officer may not be allowed to participate in the program/service. The officer can request that the board review and make a determination which could result in a waiver allowing for participation.

I hereby pledge to be responsible for my words and/or action while attending, coaching, officiating or participating in a youth sports event or any Unmatched activity, and I shall conform my behavior to the following code of conduct

All

I will not engage in unsportsmanlike conduct with any coach, parent, player, participant, official or any other attendee.

I will not engage in any behavior which would endanger the health, safety or well being of any coach, parent, player, participant, official or any other attendee.

I will not engage in any behavior that would be detrimental to the physical space in any Unmatched event, such as abusing the field, damaging the property, leaving trash, and  eating in unauthorized areas. 

I will not use drugs and/or alcohol while at any Unmatched sports game, tournament, or other league event. I will not attend, coach, officiate or participate in any such event while under the influence of drugs and/or alcohol.

I will not engage in the use of profanity nor homophobic, transphobic or misogynistic language to any youth, coach, parent, player, participant, official, or any other attendee.

I will not engage in theft as a coach, parent, player, participant, official or any other attendee.

I will not engage in any bullying, shaming, or intimidation via social media or any other form, against any coach, parent, player, participant, official or any other attendee.

I will treat any coach, parent, player, participant, official or any other attendee with respect regardless of race, creed, color, national origin, sexual orientation, gender identity, or ability.

I will not engage in verbal or physical threats or abuse aimed at any coach, parent, player, participant, official or any other attendee.

I will not engage in any sexual contact with any youth as a coach, parent, participant, official or any other attendee.

I will not initiate a fight or scuffle with any coach, parent, player, participant, official or any other attendee.

Code of Conduct applies to everyone:

I hereby agree that if I fail to conform my conduct to the foregoing while attending, coaching, officiating or participating in any Unmatched event I will be subject to disciplinary action, including but not limited to the following in any order or combination:

All

Verbal warning issued by a Unmatched board officer, coach/instructor or site representative.

Written warning issued by a Unmatched board officer, coach/instructor or site representative.

Suspension or immediate ejection from a Unmatched youth sports event issued by a Unmatched board officer, coach/instructor or site representative who is authorized to issue such suspension or ejection by a site representative or Unmatched board officer.

Suspension from multiple Unmatched youth sports events issued by a Unmatched board officer, coach/instructor or site representative who is authorized to issue such suspension by a site representative or Unmatched board officer.

Year suspension or multiple seasons suspension issued by a site representative or Unmatched board officer.

🔏 Release of Information Form

This release follows HIPAA guidelines in accordance with Maryland Care Coordination Disclosures. 

When the sharing of client information is deemed necessary, the member must specifically authorize this release. Authorization is a special and rigorous form of consent which must include a description of the information to be disclosed, the identity of the person or class of persons who may disclose the information, and to whom it may be disclosed, a description of the purpose of the disclosure, an expiration date for the authorization, and signature of the person consenting the disclosure.

The individual signing the authorization may revoke the authorization at any time. And Unmatched Athlete can never condition treatment on the willingness of an individual to sign an authorization of release of information.

For minors, it is particularly important to know whose consent is required, such as parent, state, or another court-appointed guardian, for authorization of release of information. In the State of Maryland, minors are allowed to consent for their own substance abuse treatment at any age, and at age 16, minors can consent for their own mental health treatment.

Care coordination disclosures must meet the minimum necessary standard. This means that reasonable efforts must be made by the care coordinators to limit Protected Health Information (PHI) used or disclosed to the minimum amount PHI that is reasonably necessary to achieve the purpose of the use, sharing, or request. Care coordinators should not share or access information regarding clients unless they need this information to do their job.

Volunteers’ Release

Unmatched Athlete aims to provide a safe and healthy environment for Volunteers. If a Volunteer is injured while volunteering, it is important that the Volunteer notify Unmatched Athlete immediately.

Unmatched Athlete’s liability insurance, with some limitations and exclusions, covers Unmatched Athlete for Volunteer injuries and protects Volunteers for liabilities that result from their actions. Additionally, with some limitations and exclusions, Unmatched Athlete’s accident insurance covers accidents involving Volunteers attending or participating in Events. Benefits under this coverage may be reduced based on any benefits paid by the Volunteer’s other insurance coverage.

Additionally, federal and Maryland law also protect Volunteers from liability to third parties in many circumstances.

As mentioned in Section III, Volunteers must also sign a Volunteer Agreement and Release of Liability, which waives and releases Unmatched Athlete and its directors, officers, employees, Volunteers, and agents from ordinary negligence claims caused by or arising from the Volunteer’s volunteer service for Unmatched Athlete. In accordance with Maryland law, this waiver and release does not extend to intentional harm or gross negligence.

RELEASE OF VOLUNTEER

Unmatched Athlete reserves the right to release any Volunteer from service for any reason, at Unmatched Athlete’s sole discretion. Violations of these policies may result in the Volunteer’s release from service.
